1. The service

VenueOpen provides business customers with hospitality lead intelligence derived from public datasets and other legitimate public signals. Depending on the subscription, delivery may include email reports, downloadable tables, evidence links, rankings, commentary and access to private online material.

VenueOpen is an intelligence and research service. It is not a guarantee that a venue is new, will open, remains available as a sales opportunity, or will purchase from a subscriber.

3. Cancellation and refunds

You may cancel at any time through the Stripe customer portal or by emailing us. Cancellation takes effect at the end of the paid billing period, and access ordinarily continues until then. Payments already made are not normally refunded for a change of mind or an unused portion of a billing period, except where required by law or stated in our Refunds and cancellation policy.

4. Permitted use

A subscription is for the internal business use of the subscribing organisation. You may use the information to research and approach prospective business customers.

VenueOpen supplies research information; it does not provide consent or legal authority to send marketing messages. Subscribers remain responsible for their own outreach practices.

5. Sources, accuracy and attribution

Public information can be incomplete, delayed, duplicated, changed or incorrect. Confidence labels and rankings are assessments, not certifications. You should verify material information before incurring cost, entering an agreement or relying on a lead commercially.

Source data has been modified through comparison, selection, scoring and commentary. Third-party facts, names and marks remain the property of their respective owners.

6. Intellectual property

VenueOpen owns or licenses the original selection, organisation, scoring methodology, commentary, presentation, branding and software used in the service. A paid subscription gives the customer a limited, non-exclusive, non-transferable right to use the delivered material internally during the subscription. It does not transfer ownership of VenueOpen’s compilation or methods.

7. Availability and changes

We may change sources, formats, scoring or delivery methods where reasonably necessary to improve or maintain the service. We may suspend access for non-payment, misuse, security concerns or a material breach of these terms. We do not promise uninterrupted availability of a particular public dataset or third-party source.

8. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

9. Liability

To the extent permitted by law, VenueOpen is not liable for indirect or consequential loss, lost sales, lost opportunity or decisions made from unverified lead information. Where liability can lawfully be limited, VenueOpen’s aggregate liability relating to the service is limited to the subscription fees paid by the affected customer in the three months preceding the event giving rise to the claim.

Personal information is handled as described in the Privacy policy.

11. Governing law and contact

These terms are governed by the laws of Victoria, Australia. Before starting formal proceedings, both parties should attempt to resolve the issue in good faith by contacting hello@venueopen.com.au.
